Terms & Conditions

1. General

These Terms & Conditions ("Terms") govern your use of the Sugar & Fizz website and the purchase of products offered through our online store. Sugar & Fizz is a DBA operating under our parent LLC. By placing an order you agree to be bound by these Terms. We reserve the right to update these Terms at any time without prior notice.

2. Products

Sugar & Fizz specializes in freshly baked cookies and baked goods. All products are made to order. Product availability may vary week to week. We reserve the right to discontinue or modify any product at any time without notice.

 

Product images on our website are for illustrative purposes only. Actual products may vary slightly in appearance due to the handcrafted nature of our baked goods.

3. Ordering & Payment

All orders must be placed by Wednesday at 12:00 PM (noon) EST to qualify for that week's Saturday delivery or pickup. Orders placed after the cutoff will be processed the following week.

 

Full payment is required at the time of purchase for all orders including custom orders. We accept all major credit cards, debit cards, and other payment methods available at checkout. All transactions are processed securely through CashApp and Venmo.

 

Sugar & Fizz reserves the right to cancel any order at our discretion. In the event of a cancellation initiated by Sugar & Fizz, a full refund will be issued to the original payment method.

4. Custom Orders

Sugar & Fizz offers custom and special orders. Custom orders require full payment upfront at the time the order is placed. Lead times for custom orders vary depending on the complexity and size of the order and will be communicated at the time of inquiry.

 

By placing a custom order you confirm that all details provided are accurate. Sugar & Fizz is not responsible for errors resulting from incorrect information provided by the customer. Custom orders are non-refundable once production has begun.

5. Delivery

Local delivery is available on Saturdays between 12:00 PM and 4:00 PM within our designated delivery zones. Delivery fees are calculated at checkout based on your ZIP code.

 

If no one is available at the time of delivery, your order will be left at the front door or porch. Sugar & Fizz is not responsible for orders that are lost, stolen, or damaged after delivery has been completed.

 

Our products are freshly baked and weather sensitive. We strongly recommend retrieving your order promptly upon delivery. Sugar & Fizz is not liable for product quality issues resulting from failure to retrieve your order in a timely manner.

6. Local Pickup

Free local pickup is available on Saturdays between 10:00 AM and 2:00 PM. Orders must be placed by Wednesday at 12:00 PM noon to qualify for that week's Saturday pickup.

 

Orders will be placed in a cooler on the porch. Customers are required to bring a copy of their order confirmation and must only retrieve their own order. Sugar & Fizz is not responsible for missing or incorrect orders resulting from failure to follow pickup procedures.

 

Sugar & Fizz is not responsible for orders that are not picked up within the designated pickup window, or for product quality issues resulting from delayed pickup.

7. Shipping

Under Cottage Law, we are unable to ship at this time. 

8. Refund Policy

All sales are final. Due to the perishable nature of our baked goods, Sugar & Fizz does not accept returns or issue refunds except in cases where a product quality issue is directly attributable to Sugar & Fizz.

 

If you believe you have received a product with a quality issue, you must contact us within 24 hours of receipt with photographic evidence. Sugar & Fizz reserves the right to determine at our sole discretion whether a quality issue qualifies for a refund or store credit. No refunds will be issued after 24 hours of delivery or pickup.

9. Allergen Disclaimer

IMPORTANT: Our products are produced in a home kitchen that regularly handles and processes the following allergens:

 

• Wheat / Gluten

• Eggs

• Dairy

• Nuts and Tree Nuts

 

While we take precautions to prevent cross-contamination, we cannot guarantee that any product is free from allergens. Our products are not suitable for individuals with severe allergies to any of the above ingredients. By placing an order you acknowledge and accept this risk. Sugar & Fizz is not liable for any allergic reactions resulting from consumption of our products.

 

If you have questions about specific ingredients or allergens please contact us before placing your order.

10. Sales Tax

Sugar & Fizz collects applicable sales tax in accordance with state and local tax laws. Virginia orders are subject to a 1% grocery tax on baked goods. Tax rates for orders shipped to other states are calculated based on applicable local tax laws at the time of purchase.

11. Intellectual Property

All content on the Sugar & Fizz website including but not limited to images, logos, product names, and text is the property of Sugar & Fizz and its parent LLC. Unauthorized use, reproduction, or distribution of any content is strictly prohibited.

12. Limitation of Liability

To the fullest extent permitted by law, Sugar & Fizz and its parent LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of our products. Our total liability to you for any claim shall not exceed the amount paid for the order in question.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Chesterfield County, Virginia.

14. Email Communications

By placing an order with Sugar & Fizz you agree to receive transactional emails related to your order including order confirmations, delivery notifications and pickup instructions. These emails are necessary to fulfill your order and cannot be opted out of while maintaining an active order.

 

By subscribing to our newsletter you consent to receive marketing communications from Sugar & Fizz including new product announcements, promotions, and weekly menu updates. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us at hello@sugarandfizz.co.

 

Sugar & Fizz will never sell, trade or share your email address with third parties for their marketing purposes. Your information is used solely to communicate with you about your orders and our products.
